A New York judge ordered Donald Trump to testify on Monday in a lawsuit by a group of protesters who said his security guard attacked them during a demonstration outside Trump Tower in 2015.
Bronx Supreme Court Justice Doris Gonzalez ordered the deposition to take place on Monday at Trump Tower in Manhattan. It is recorded on video and then played back when the case goes to court.
The lawsuit focuses on a dispute between a group of protesters and Trump’s security guards during a protest in front of Trump Tower in September 2015.
The group protested Trump’s anti-Mexican and anti-immigrant rhetoric, saying in the lawsuit it was concerned about “the potential of these statements to incite violence against the Mexican immigrant community.”
During the demonstration, Trump’s then security chief Keith Schiller tore away two protest signs from the group that read: “Trump: Make America Racist Again”.
One of the demonstrators, Efrain Galicia, tried to get one of the signs back, then Schiller hit him in the head, video shows.
Lawyers are demanding a testimony from Trump to see if he is responsible for Schiller’s behavior.
“After the defendants fought unsuccessfully for years to prevent Donald Trump from testifying under oath, we will testify in this case on Monday,” said Benjamin N. Dictor, an attorney for the plaintiffs. “We look forward to presenting this case, including Mr. Trump’s video testimony, to the jury at their trial.”
The group protested twice in front of Trump Tower before the demonstration in September. Both times, Trump Organization security told the group that they could not protest on the sidewalk. A New York City Police officer corrected the guards, saying the group had the right to demonstrate in public places, according to the lawsuit.
As president, Trump’s lawyers said the president’s immunity protected him from multiple civil and criminal cases filed against him. The courts rejected this argument, but it succeeded in delaying litigation that has become a central part of his post-presidency life.
Another New York judge has ordered Trump to testify earlier this year in a libel suit brought by Summer Zervos, a former candidate on reality TV show The Apprentice. Zervos accused Trump of defaming her by denying her allegations of sexually abusing her in 2007.
