Referee knocks down Trump’s NDA challenge against Omarosa

Trump has targeted Manigault Newman through his campaign organization after writing a confessional book about her tenure as communications director for the Office of the Public Liaison at the White House. For years she was a mainstay in Trump’s environment before he entered politics, first as a candidate on the TV show “The Apprentice” and later as an executive in his company of the same name.

“Donald has used this type of annoying litigation for years to intimidate, harass and bully! The tyrant has finally found his match! ”She said in a statement.

Brown rejected the Trump campaign argument that Manigault Newman – commonly referred to by her first name – disclosed confidential information in her book and other public statements.

“The statements do not contain any hard data such as internal survey results or donor financial information. Rather, they are for the most part just expressions of unflattering opinions that are considered “confidential information” solely because of the naming of Mr. Trump, “he wrote.

Trump has long used nondisclosure agreements as a cudgel against embarrassing revelations by dissatisfied employees, both in his business and political activities. However, given their often broad scope, they have found it difficult to stand up to legal scrutiny.

Earlier this year, a federal judge ruled that such an NDA was so blanketly vague under the law, amid a dispute with Trump’s former Hispanic outreach director Jessica Denson, who accused the campaign of gender discrimination in a separate trial of New York State was unenforceable.

The Trump campaign had attempted to distinguish between Denson’s case and Manigault Newman, although the referee found this argument unconvincing, as Trump’s side “provides no basis for this distinction”.

“While the Denson decision is not a binding precedent, the arbitrator finds it convincing and in line with the principles of New York contract law,” Brown wrote in his ruling.

Through a spokesman, Trump unleashed a personal attack on Manigault Newman that did not address the content of the case.

“I gave Omarosa three attempts at The Apprentice and she failed,” said the former president. “At her desperate request I tried her at the White House and she failed there too, people really hated her. At least I don’t have to let her fail now.”
